IDENTITY AND ADDRESS OF THE RESPONSIBLE PARTY. DELIVERYPS, S.A. DE C.V. (DeliveryPs) is responsible for the processing of your personal data.

COLLECTED PERSONAL DATA. In order to establish a legal relationship between DeliveryPs and the Data Subject, DeliveryPs will collect the following categories of Personal Data: (i) Identification data, (ii) Images, videos, and sounds from surveillance cameras at DeliveryPs facilities and perimeter areas, (iii) Contact information, and (iv) Tax and/or financial data.

SENSITIVE PERSONAL DATA. DeliveryPs does not collect sensitive personal data; if necessary, your express consent will be requested for such purposes. Any other data you provide that is not required under this Privacy Notice will be immediately deleted from DeliveryPs databases.

PRIMARY PURPOSES. To establish a legal relationship between DeliveryPs and the Data Subject, DeliveryPs will process Personal Data for the following purposes:

  1. Quotation and provision of parcel delivery, storage, and logistics services that you require.
  2. Sending information related to the status of the service and/or product contracted, as well as tracking these through our platforms.
  3. Managing and processing payments for the services and/or products.
  4. Issuing the corresponding tax receipts for the services and/or products contracted.
  5. Managing and allowing access to your account, if registered on any of DeliveryPs web platforms.
  6. Processing and attending to your requests if you contact our customer service department.
  7. DeliveryPs may carry out video surveillance inside and around its facilities to preserve and guarantee your safety and that of DeliveryPs facilities.

SECONDARY PURPOSES. Additionally, DeliveryPs may process Personal Data for purposes that do not give rise to a legal relationship between DeliveryPs and the Data Subject and are not necessary for the existence of such a legal relationship. These include:

  1. Conducting surveys to evaluate the quality of services and/or products provided by DeliveryPs.
  2. Sending you information about our services, products, and promotions through various means.
  3. Inviting you to participate in raffles, contests, events, and incentive programs. If you do not want your personal data to be processed for any of the purposes described in this section, please send an email to contacto@deliveryps.com. If you do not express your refusal to process your personal data within 5 business days, it will be understood that you have given your consent.

USE OF COOKIES AND WEB BEACONS.We inform you that on our website we may use cookies, web beacons, and other tracking technologies that allow us to fulfill the purposes stated in this Privacy Notice. The different types of cookies we use are:

  • Essential cookies: to enable proper use of our website, these cannot be disabled.
  • Cookies to remember your preferences and experience: these cookies allow us to remember your preferences, navigation options, and customized features.
  • Cookies for performance and analysis: we may use our own and third-party cookies to identify how you use our services to improve their performance and future developments.
  • Advertising cookies (own and third-party): we may place our own and third-party advertising cookies (such as from business partners and group companies) to show you ads that we consider relevant to you.

TRANSFERS. To provide services properly, we carry out various data transfers and/or remissions. Personal data may be transferred or referred to subsidiaries or affiliates of DeliveryPs, with the understanding that your personal data will always be treated in accordance with the consent granted in this Privacy Notice and that such subsidiaries and affiliates operate under the same personal data protection policies as DeliveryPs and are always subject to confidentiality obligations.
Your personal data may be transferred if necessary to comply with the law or at the request of a competent authority, duly substantiated and motivated. DeliveryPs will ensure that the information disclosed is strictly necessary according to the law or the request.
Your personal data may be shared with the recipient, and you declare that you obtained the recipient's personal data lawfully. For online payments, DeliveryPs uses third-party payment processors. These third parties are required to keep your data strictly confidential and use it solely for the purposes authorized by DeliveryPs under this Privacy Notice.
Any additional data transfer carried out by DeliveryPs that requires your consent will be personally notified to you so that you can consent or deny such consent.

ARCO RIGHTS AND REVOCATION OF CONSENT. You have the right to know what personal data we have about you, what we use it for, and the conditions of its use (access). It is also your right to request the correction of your personal information if it is outdated, inaccurate, or incomplete (rectification); to have it deleted from our records or databases (cancellation); and to object to the use of your personal data for specific purposes (opposition). These rights are known as ARCO rights. To exercise your ARCO rights, you must send your request to the Data Protection Department at the email address contacto@deliveryps.com. The request must contain the following information:

  1. Name of the data subject.
  2. Address and email address to notify you of the response to your request.
  3. Clear and precise description of the data regarding which you seek to exercise the corresponding right.
  4. Purpose of the request.
  5. Any element that facilitates the location of the data. You must also attach a copy of your identification and, if applicable, the document that proves legal representation.

The response time for the request will be 20 business days from the day the ARCO rights exercise request is received. The response will be communicated to you within the aforementioned period via the email address you provided in your request or by sending a letter to the address provided therein. Once the notification is received, you will have 15 business days to enforce it if applicable. At any time, you may revoke the consent given for the processing of your personal data so that DeliveryPs stops using it. To do so, you must submit a request in the aforementioned terms to exercise ARCO rights. The procedure to be followed will be the same as the one provided for the exercise of ARCO rights. If your request is approved, your data will no longer be processed by the Responsible Party.

MEANS TO LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA.Your personal data will be treated with the utmost confidentiality, taking care of the administrative, physical, and technical security measures that DeliveryPs implements in its internal security policies and procedures, avoiding possible illicit disclosure of data and limiting its use to what is established in this Privacy Notice.
DeliveryPs is committed to using reasonable means of protection to ensure the security of personal data. In the event of a breach that affects the security of personal data, DeliveryPs is committed to immediately notifying the data subject of the nature of the incident, the personal data involved, recommendations that the data subject may take, immediate corrective actions, and the means to obtain more information.

CHANGES TO THE PRIVACY NOTICE. This privacy notice may be modified, changed, or updated due to new legal requirements; our own needs for the products or services we offer; our privacy practices; changes in our business model, or legislative reforms.
Any changes to this Privacy Notice will be informed to you through the following means: (i) via notification sent to the email address you provided to us and/or (ii) by posting on the website www.deliveryps.com. If the purposes for which your personal data is processed are modified, your consent will be requested again if necessary. Update date: March 4, 2024.
